"Non-persons" in U.S. history

A 1970 California Medicine editorial acknowledged that a form of pathological lying called semantic gymnastics is an essential strategy for dehumanizing individuals before and after birth in order to promote abortion and euthanasia. The editorial stated, “very considerable semantic gymnastics” would be required to avoid “the scientific fact which everyone really knows that human life begins at the moment of conception” and “to rationalize abortion as anything but taking a human life.”  (“A New Ethic for Medicine and Society," California Medicine 113 (September 1970): 68)  

In United States history, several groups of people have at one time been refused the legal designation as a “person” and consequently have been denied the rights and legal protection afforded by the U.S. Constitution. The following quotes are taken from Dehumanizing the Vulnerable: When Word Games Take Lives by William Brennan. 

American Indians 

Writing in The American Law Review of 1881, George Canfield summed up the precarious legal standing of Indians that permitted the wholesale assaults on Indian lands and lives: “An Indian is not a person within the meaning of the Constitution” (1881, 28)

 

Blacks 

In Dred Scott v. Sanford (1857) the United States Supreme Court—drawing upon the concepts “nonpeople” and noncitizens”—reaffirmed the denial of fundamental rights to black people and sanctioned the expansion of the slave system westward. Chief Justice Roger Brooke Taney asserted that Negroes are not “constituent members” of the “sovereign people” and “are not included, and were not intended to be included, under the word ‘citizen’ in the Constitution, and can therefore claim none of the rights and privileges which that instrument provides for and secures to citizens of the United States.” (Dred Scott v. Sanford, 19 Howard 404 (1857))

     Throughout the opinion rendered in Dred Scott, the terms “people” and “citizens” are “synonymous terms, and mean the same thing” and therefore often appear together. Taney highlighted those clauses in the Constitution that, he maintained, indicated that members of “the negro race” were “not regarded as a portion of the people or citizens of the Government.” He added that “it is too plain for argument, that they have never been regarded as part of the people or citizens of the State” (ibid., 404, 411, 412).

     There is a striking resemblance between the above constructs and the “person” and “nonperson” designations that operated and deny legal rights to today’s unborn victims. The Roe v. Wade assertion that “the word ‘person,’ as used in the Fourteenth Amendment, does not include the unborn” is closely related to the Dred Scott declaration that blacks are excluded from membership in the “sovereign people” and “are not included, or were not intended to be included, under the word ‘citizen’ in the Constitution.” Just as exclusion of unborn children from the constitutionally protected category of “person” relegates them to the rightless state of “nonperson,” the exclusion of blacks from the constitutionally secure classification of “sovereign people” or “citizens” reduced them to the rightless status of “nonpeople” or “noncitizens.”

     Borrowing a page directly from Roe (“the unborn have never been recognized in the law as a person in the whole sense”, federal circuit court judge and former law professor John T. Noonan characterized the plight of blacks under the Dred Scott ruling in the following manner: “Nowhere henceforth could a black in the United States be protected by federal law as person I the whole sense of the term” (1979, 81).  

 

Women 

One would think that after enactment of the Nineteenth Amendment to the U.S. Constitution in 1920 granting women the right to vote, their personhood had been decisively and unequivocally established in the fabric of American law. This, however, proves to be an unwarranted assumption. In Commonwealth v. Walosky (1931) the Massachusetts Supreme Court decided that women could not serve on juries because they were not persons according to state law. In the words of Judge C.J. Rugg, who authored this decision: “The intention of the Legislature must have been, in using the word ‘person’ in statutes concerning jurors and jury lists, to confine its meaning to men.” Moreover, he declared: “It is unthinkable that those who first framed and selected the words for this statute … had any design that it should ever include women within its scope” (Ibid., 660-661).
 

The unborn 

The term “nonperson” has emerged as the most far-reaching and disastrous epithet ever invoked to devalue human life in the womb. When the United States Supreme Court’s Roe v. Wade decision (1973) declared that “the word ‘person,’ as used in the Fourteenth Amendment, does not include the unborn,” it sounded the legalized death knell for huge numbers of unborn humans. Since then the nonperson concept has served as a foundation for countless articles, conferences, and court rulings designed to uphold and expand the abortion liberty as well as bolster experimentation on the unwanted unborn and the harvesting of fetal organs for transplantation. The Planned Parenthood of Southeastern Pennsylvania v. Casey (1992) decision reaffirming Roe v. Wade and allowing only the most minor abortion restrictions reiterated the nonperson doctrine promulgated in Roe. “Since the unborn have never been recognized as persons in the whole sense,” reasoned Associate Justice John Paul Stevens, “an abortion is not ‘the termination of life entitled to Fourteenth Amendment protection.’”
